The Legal Foundation

The Aanbestedingswet 2012, last amended to transpose EU Directive 2014/24/EU, governs all public purchasing above defined thresholds. It is supplemented by the Aanbestedingsbesluit (Public Procurement Decree), the Gids Proportionaliteit (Proportionality Guide), and for public works, the ARW 2016. Together, these create a framework built on five principles: equal treatment, non-discrimination, mutual recognition, proportionality, and transparency.

Thresholds That Determine Everything

From January 2026, EU thresholds for the Netherlands are EUR 140,000 for central government supplies and services, EUR 216,000 for sub-central authorities, and EUR 5,404,000 for works contracts. Above these values, tenders must follow full European procedures and be published on TED (Tenders Electronic Daily) through TenderNed. Below them, national rules apply, but publication on TenderNed is still strongly encouraged.
